Terms of Service

1. Who you are contracting with
These Terms form an agreement between you and OpenHousePal ("OpenHousePal", "we", "us"). By creating an account or using the service at openhousepal.io, you agree to these Terms. If you are using the service on behalf of an organization, you confirm you have authority to bind that organization.
2. The service
OpenHousePal provides realtors with branded open house sign-in pages and a dashboard for captured visitor leads.
3. Accounts
You must provide accurate information, keep your credentials confidential, and are responsible for activity under your account.
4. Acceptable use
You will not:
- Use the service unlawfully or for fraud, spam, or harassment.
- Infringe intellectual property or privacy rights of others.
- Interfere with security, probe, scan, scrape, or attempt to bypass technical limits.
- Upload malware or harmful code.
- Resell, redistribute, or reverse engineer the service.
5. Visitor data
You are responsible for ensuring you have a lawful basis to collect visitor information through your branded sign-in page and for complying with applicable privacy laws.
6. Payments, subscription, and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by the Paddle Checkout Buyer Terms. Subscriptions renew automatically until cancelled.

8. Intellectual property
We retain all rights in the OpenHousePal service, software, and branding. You retain rights to content you upload (logo, photos, brand assets) and grant us a limited license to host and display them solely to provide the service.
9. Service availability
The service is provided "as is". We do not guarantee uninterrupted or error-free operation and disclaim implied warranties to the fullest extent permitted by law.
10. Suspension and termination
We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated/serious policy violations. You may cancel at any time. On termination, access to the dashboard ends; you may export your data before cancelling.
11. Liability
To the fullest extent permitted by law, our aggregate liability is limited to the fees you paid in the 12 months before the claim. We are not liable for indirect, consequential, incidental, or special damages, including lost profits, data, or goodwill. Nothing limits liability that cannot be limited by law.
12. Changes
We may update these Terms; continued use after changes constitutes acceptance. Material changes will be communicated through the service.
